What is HRA (House Rent Allowance)?

House Rent Allowance (HRA) is a component of your salary provided by employers to help employees meet their rental accommodation expenses. Under Section 10(13A) of the Income Tax Act, 1961, you can claim exemption on HRA, reducing your taxable income significantly.

The exemption amount is calculated as the least of the following three:

  1. Actual HRA received from employer
  2. Actual rent paid minus 10% of basic salary
  3. 50% of basic salary (for metro cities: Delhi, Mumbai, Kolkata, Chennai) OR 40% of basic salary (for non-metro cities)

Why Rent Receipts are Mandatory

From FY 2016-17 onwards, the Income Tax Department has made it mandatory to submit proof of rent payment to claim HRA exemption. Here’s what you need:

Revenue Stamp Rules

As per the Indian Stamp Act, rent receipts for amounts exceeding ₹5,000 should have a ₹1 revenue stamp affixed. However, for HRA purposes:

  • Revenue stamp is not mandatory for income tax filing
  • Some employers may require it for their internal records

Monthly vs. Quarterly Receipts

  2. Get a declaration from landlord stating they don’t have PAN

Is this receipt legally valid?

Can I generate receipts for previous months?

Yes, you can backdate receipts, but ensure the dates match your actual payment records. Backdating for tax fraud is illegal, but correcting documentation for actual rent paid is acceptable.

Do I need landlord’s signature on the receipt?

Ideally yes, but for HRA exemption, many employers accept receipts without signature if supported by rent agreement and bank transfer proof. We recommend getting signatures for amounts above ₹10,000/month.

What if I pay rent to parents?

You can claim HRA for rent paid to parents if they own the property and show this rental income in their tax return. Generate receipts in their name, and they must report this as “Income from House Property.”

Is revenue stamp mandatory?

No, for income tax purposes, revenue stamp is not mandatory. It’s only required if the monthly rent exceeds ₹5,000 and you’re using the receipt as legal evidence in court. For HRA, a signed receipt is sufficient.

Can I pay rent in cash?

Cash payments are valid but risky. If rent exceeds ₹20,000 per month, cash payments are not advisable. Use bank transfer, UPI, or cheque for amounts above ₹20,000 to have a payment trail.
